SSC Niantic Operating Co., LLC<\/a> (Dist. Conn. 2017), is significant because it departs from a handful of earlier decisions that have found or at least assumed state employment protections were preempted. Those decisions are discussed on pages 672-81 of the book.<\/p>\n<p style=\"text-align: justify\">Even though I largely agree with the result in <em>Noffsinger<\/em>, the court\u2019s reasoning (especially regarding obstacle preemption) is rather cursory and leaves some key arguments\u00a0(like why Congress might want to preempt state employment protections) unaddressed. The key passage in the decision can be found on pages 10-11:<\/p>\n<blockquote>\n<p style=\"text-align: justify;padding-left: 30px\">\u201cGiven that the CSA nowhere prohibits employers from hiring applicants who may be engaged in illegal drug use, defendant has not established the sort of \u2018positive conflict\u2019 between [state law] and the CSA that is required for preemption under the very terms of the CSA. . . . Nor does any tension between [state law] and the CSA rise to the level of the \u2018sharp\u2019 conflict required to establish obstacle preemption under the case law.\u201d<\/p>\n<\/blockquote>\n<p style=\"text-align: justify\">The <em>Noffsinger<\/em> decision is less significant for recognizing a private cause of action against employers. That\u2019s because Connecticut\u2019s medical marijuana law, unlike the Massachusetts law at issue in <a href=\"https:\/\/my.dev.vanderbilt.edu\/marijuanalaw\/2017\/07\/massachusetts-court-finds-employers-must-accommodate-employees-off-duty-medical-marijuana-use\/\" target=\"_blank\"><em>Barbuto<\/em><\/a>, expressly bars employers from \u201crefus[ing] to hire a person or . . . discharg[ing], penalize[ing] or threaten[ing] an employee solely on the basis of such person\u2019s or employee\u2019s status as a qualifying patient.\u201d<\/p>\n<p style=\"text-align: justify\">Hat tip to Doug Greene and <a href=\"http:\/\/lawprofessors.typepad.com\/marijuana_law\/2017\/08\/federal-district-court-in-connectcut-rejects-preemption-claims-by-employer-sued-after-rescinding-emp.html\" target=\"_blank\">Doug Berman<\/a> for bringing the case to my attention.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The decision in Noffsinger v.
